Court Blocks $1 Billion Natural Gas Pipeline Over Water Quality Concerns
A federal appeals court has dealt a significant blow to the $1 billion Northeast Supply Enhancement (NESE) project, which would deliver natural gas from Pennsylvania to New York City via new pipelines beneath Raritan Bay.
The 3rd U.S. Circuit Court of Appeals vacated a key New Jersey environmental permit needed for the project, citing that the state's Department of Environmental Protection failed to adequately explain how the project would comply with water quality standards.
The court remanded the case back to NJDEP and directed the agency to address several issues related to dredging and project monitoring requirements.
