FERC Wins Appeal to Defend Approval of Venture Global's CP2 LNG Export Terminal
The Federal Energy Regulatory Commission (FERC) has won its appeal to defend its approval of the CP2 LNG export terminal project in Louisiana. The commission's decision was upheld by the US Court of Appeals for the DC Circuit on August 25, 2026. FERC had initially approved the project, which is being developed by Venture Global, under the Natural Gas Act.
The court ruled that FERC reasonably interpreted the act when approving the project. Environmental groups, including the Sierra Club, had argued that FERC did not adequately consider potential harms associated with the project and whether they outweighed its benefits.
