Athena Bitcoin Settles Telemarketing Text Lawsuit for $4.5 Million
Athena Bitcoin has agreed to settle a $4.5 million lawsuit over telemarketing texts sent to customers who had previously requested to stop receiving messages.
The proposed settlement, which will be reviewed by Judge Mark E. Walker on August 10, would fund two classes of recipients: U.S. subscribers and Florida residents under the state's Telephone Solicitation Act.
Athena Bitcoin denies any wrongdoing but has agreed to create a $4.5 million settlement fund. However, claimants may face reduced payouts due to fees, expenses, notice costs, and claim volume.
The court-authorized settlement FAQ states that each eligible participant's payment will depend on the number of timely, valid claims. The pre-hearing materials do not provide an accepted-claim count or final deductions, making it impossible to calculate a per-claimant payment at this time.
