The revised open banking proposal from the Consumer Financial Protection Bureau has ignited a lobbying frenzy in Washington as traditional banks and fintech companies vie for control of consumer financial data. The CFPB transmitted its revised proposal to the White House on August 3-9, which aims to settle contentious issues around data access rights, fee structures, liability frameworks, security standards, and third-party access to consumer banking data.

The traditional banking establishment is leading the charge against fintech companies, arguing that they need latitude to charge fees when third parties access customer data held on their systems. They also cite security concerns and liability protections as key issues. In contrast, fintech upstarts see frictionless access to consumer banking data as crucial to their business models.

The original CFPB rule, finalized in October 2024, favored fintech companies by requiring banks to provide data access without charging fees. Banks challenged the rule's legal foundations and put the entire framework in limbo. The revised proposal now on the White House's desk has sparked a multi-front war between financial institutions on both sides.
