Bitcoin Tax Conundrum Hits Austrian Business Owners
Business owners in Austria must carefully classify their Bitcoin holdings to avoid tax complications.
The classification of Bitcoin as private or business assets depends on the purpose they serve, not just the account used for purchase. If Bitcoin are received as payment for goods or services, used regularly for business payments, held as part of a crypto mining or trading operation, or deliberately deployed as part of a corporate treasury strategy, they are likely to be considered business assets.
Sole traders and limited companies are treated differently in this regard. Sole proprietors must keep their private and business assets separate for tax purposes, while limited company Bitcoin bought by the company belong to the company, regardless of where they are stored. Shareholders may not simply move them to a personal wallet without triggering additional tax.
When selling business Bitcoin, gains can be subject to corporation tax or even capital gains tax if distributed to shareholders. Business owners should document every transaction and transfer, as well as keep separate wallets, exchange accounts, and transaction histories for private and business holdings.
