A regulatory dispute is brewing between the CME Group and the US Commodity Futures Trading Commission (CFTC) over the approval of new financial products. The CME had sought to offer 24-hour trading in West Texas Intermediate crude futures, but was rejected by the CFTC. This decision comes on the heels of the CFTC allowing perpetual futures trading for cryptocurrencies such as Bitcoin and Ethereum without a formal rulemaking process.

CME Chairman Terry Duffy criticized the agency's inconsistency, stating that they failed to explain how they would oversee perpetual futures policy while blocking the exchange's 24-hour commodity product. The lack of transparency has sparked concerns about regulatory favoritism in the industry.

Jaret Seiberg, an analyst at TD Cowen, noted that the CFTC had previously viewed perpetual futures as swaps but approved them without formal rulemaking. This has led some to speculate that the CME may have a legal advantage over other exchanges.

The crypto industry is also weighing in on the issue, with some arguing that the CFTC's actions are designed to stifle competition and maintain existing market dynamics.
