CFTC Cracks Down on Crypto: Will Congress Step Up with CLARITY Act?
The Commodity Futures Trading Commission (CFTC) has indicated it will establish rules for the cryptocurrency market if Congress does not pass the CLARITY Act. The agency argues its existing authority under the Commodity Exchange Act is sufficient to regulate digital assets, such as Bitcoin and Ether, as commodities.
The CFTC's stance reflects growing frustration with the lack of progress on the CLARITY Act, which has stalled in committee since late 2024. Market growth, consumer protection, and international competition have driven the agency's proactive approach. The total market capitalization of cryptocurrencies has rebounded to over $2 trillion, increasing their systemic importance.
The CFTC is expected to prioritize rules concerning custody, market surveillance, and registration requirements for trading platforms and intermediaries. Establishing robust anti-fraud and anti-manipulation protocols for spot markets in digital commodities will be a key focus area.
