CFTC Dismissal Bid Seeks to Settle Crypto Perpetual Futures Regulatory Gray Area
The Commodity Futures Trading Commission (CFTC) is seeking dismissal of CME Group's lawsuit against Kalshi's Bitcoin perpetual futures. In a 30-page filing, the CFTC argues that CME has failed to demonstrate any actual competitive injury caused by its approval of the contract.
CME had claimed earlier that Kalshi's product may become a competitive threat to retail traders, but the CFTC highlights that CME admitted there was no demand from its clients for the perpetual futures. Additionally, the CFTC points out that CME's cryptocurrency futures trading has grown after the approval.
The CFTC believes that CME cannot prove any concrete financial harm from the approval and is defying CME's core reasons for initiating the lawsuit. The case may impact how regulators in the United States regulate crypto perpetuals, which have seen significant growth with Kalshi's Bitcoin perpetuals trading over $100 million on its first day.
