CFTC Moves Forward with Own Crypto Rules if Clarity Act Fails
CFTC Chairman Mike Selig has announced that his agency will move forward with creating its own rules for crypto asset trading if Congress fails to pass the Digital Asset Market Clarity Act. The bill, which aims to provide clarity on crypto regulations, is currently stalled in the Senate due to opposition from Democrats over ethics concerns.
Selig stated that he has directed his staff to explore new rules for crypto assets using existing agency authority. He said the goal is to create a regulatory category for crypto firms similar to the CFTC's designated contract markets framework, which would provide a clear and consistent approach to regulating these markets.
The SEC also proposed its own digital asset rules this week, offering crypto companies a potential safe harbor from being treated as investment contracts. However, CFTC Chairman Selig emphasized that his agency is committed to moving forward with its own plan if Congress fails to act.
