The Commodity Futures Trading Commission (CFTC) has issued a stern reminder to prediction markets to ensure transparency in their pricing disclosures. The advisory, Staff Advisory No. 26-08, focuses on two core obligations under the Commodity Exchange Act: listing only contracts that are not readily susceptible to manipulation and implementing mechanisms to prevent price distortion.
The guidance specifically targets cash-settled contracts, requiring exchanges to scrutinize data sources and computational procedures used to determine settlement values. The CFTC also flagged vague or overly broad product specifications as problematic in self-certifications and approval requests.
The advisory's release coincides with an Advance Notice of Proposed Rulemaking (ANPRM) that invites public comment on broader prediction market regulations by April 30, 2026. This suggests the CFTC is actively considering whether the existing regulatory framework needs updating to account for the unique characteristics of prediction markets.
