CFTC Sets Sights on Unilateral Crypto Regulation
The Commodity Futures Trading Commission (CFTC) is taking steps to establish its own framework for regulating cryptocurrencies, in case Congress fails to pass the Clarity Act. CFTC Chair Michael Selig has directed agency staff to develop a rulemaking plan using existing regulatory powers.
Selig still favors bipartisan legislation, but if it stalls further, regulators may act unilaterally. This move could extend oversight to crypto exchanges and existing registrants, and permit tailored leveraged and margined trading on eligible platforms.
The proposed approach raises regulatory risk for centralized exchanges (CEXs), decentralized exchanges (DEXs), and DeFi projects. It also has implications for security, adoption, and market structure in the cryptocurrency space.
