CFTC Threatens To Regulate Crypto If Congress Fails To Act On CLARITY Act
The Commodity Futures Trading Commission (CFTC) has announced that it will establish rules for the cryptocurrency market if Congress fails to pass the CLARITY Act. The bill aims to provide a comprehensive legal framework for digital commodities, but has stalled in committee.
The CFTC's decision reflects growing frustration with legislative gridlock and a desire to fill the regulatory vacuum. The agency asserts that its existing authority under the Commodity Exchange Act is sufficient to regulate digital assets that are classified as commodities, such as Bitcoin and Ether.
Market growth, consumer protection, and international competition have driven the CFTC's proactive approach. The total market capitalization of cryptocurrencies has rebounded to over $2 trillion, increasing the systemic importance of the asset class. The agency plans to prioritize rules concerning custody, market surveillance, registration requirements for trading platforms and intermediaries, and anti-fraud and anti-manipulation protocols.
