CFTC Unveils Backup Plan for Crypto Regulation Amid CLARITY Act Gridlock
CFTC Chair Michael Selig has directed agency staff to explore a regulatory fallback for digital asset markets using existing statutory powers. This move comes as the CLARITY Act remains stuck in congressional limbo.
The proposed framework would allow certain crypto exchanges to apply for designation as CFTC-regulated 'crypto asset markets' dedicated to leveraged or margined trading. However, this falls short of creating a new rule and does not grant the CFTC broad spot-market authority that the CLARITY Act is meant to provide.
Selig emphasized that Congress remains the preferred avenue for establishing regulatory clarity in the crypto market. He attributed the delay in passing the CLARITY Act to 'Democratic obstruction.'
