CFTC Unveils Plan to Regulate Crypto Market, Regardless of Clarity Act Passage
The Commodity Futures Trading Commission (CFTC) is moving forward with its plans to regulate the cryptocurrency market, despite the uncertainty surrounding the Clarity Act's passage in the Senate. CFTC Chairman Michael Selig stated that the industry will receive rules regardless of whether Congress passes the legislation, which would grant the primary oversight of most digital asset spot markets.
In a Bloomberg Television interview, Selig emphasized that the agency can implement regulations through existing authority, rather than relying solely on new legislation. He noted that staff have been directed to explore an asset market designation, similar to the existing category of designated contract markets, which would allow registered and unregistered exchanges to qualify for this label.
The CFTC's plan leans on its existing regulatory authority over derivatives, futures, and swaps tied to digital assets, as well as enforcement powers against fraud in spot commodity transactions. Analysts say the market structure question still comes down to what the agency lacks without the Clarity Act: routine supervisory power over spot exchanges.
