China Tightens Overseas Investment Rules Amid Tech Security Fears
China has tightened its rules on overseas investments in an effort to address security risks related to technology. The new Regulation on Outbound Investment was announced by the State Council on June 1, 2026, and takes effect on July 1, 2026.
The regulation consolidates existing fragmented rules into a single framework covering foreign investments, technology transfers, and data flows involving Chinese firms and individuals. It explicitly targets indirect methods of moving restricted technologies or personnel across borders.
Chinese authorities have been granted sweeping enforcement powers under the new regulations, including the ability to order divestitures, impose fines, and take retaliatory measures against foreign entities deemed threats to national security.
