CLARITY Act Delay Fuels Market Uncertainty as Banks Push Back
The CLARITY Act aims to reduce regulatory overlap between the SEC and CFTC by giving certain digital assets that become sufficiently decentralized to fall under CFTC oversight rather than being regulated as securities. This could provide a clearer set of rules for exchanges, token issuers, and institutional investors.
Supporters argue this would make it easier for companies to launch products and list assets without constantly worrying about changing regulatory interpretations. However, large banks are pushing back against the bill, citing concerns that it may weaken the SEC's authority over high-risk assets and create a separate, less demanding framework for crypto businesses.
Banks also worry about increased competition from digital-dollar products such as stablecoins, which could compete with traditional bank deposits and money-market products. The Senate's decision to delay voting on the bill until September has added uncertainty to the market, and traders are now looking at a broader set of factors including Federal Reserve policy and overall liquidity conditions.
