CLARITY Act Delayed Again as Senate Adjourns for August Recess
The long-awaited Digital Asset Market Structure Clarity Act has hit another roadblock in its journey to become law. Despite clearing the House in July 2025 with a bipartisan vote of 294-134, the bill failed to secure a floor vote before the Senate's August recess. The delay was attributed to Democrats' refusal to agree on a procedural timeline that would have allowed the measure to reach the floor before lawmakers scattered for their break.
Senate Majority Leader John Thune confirmed on August 7, 2026, that the vote would be postponed until September. The CLARITY Act has been stuck in negotiations, objections, and delays since its passage in the House. The bill's sticking points include ethics provisions tied to President Trump's family businesses, concerns raised by law enforcement agencies, and pointed objections from the banking industry.
The postponement compresses an already tight legislative calendar into a chaotic fall session with midterm elections looming in November. Congress will have a narrow window to act on the CLARITY Act when it reconvenes in September. GOP senators championing the legislation alongside crypto industry leaders must find a way to address Democratic concerns while mollifying community bankers worried about stablecoin competition.
