CLARITY Act Faces Key Senate Vote Amid Regulatory Uncertainty

The Senate is set to hold a crucial procedural vote on the CLARITY Act, which aims to establish clearer rules for determining how digital assets are regulated in the US. The legislation needs 60 votes to advance and has faced opposition from both Democrats and Republicans over issues such as ethics restrictions and stablecoin rewards.

The CLARITY Act would divide oversight responsibilities between the Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC), giving the CFTC a larger role in overseeing digital commodities. Supporters argue that congressional action is needed to replace years of uncertainty over which federal regulator has authority over different digital assets and transactions.

The bill has undergone several revisions, including changes made by Senate Banking Committee Chairman Tim Scott and Senator Cynthia Lummis, one of the legislation's leading supporters. However, Democrats have pushed for stronger ethics provisions governing federal officials with financial interests in cryptocurrency businesses, citing concerns about President Donald Trump and his family's crypto ventures.

Banking groups have also raised objections over provisions governing rewards paid in connection with stablecoins, arguing that they could encourage customers to move deposits out of traditional banks. The bill includes an attempted compromise on this issue, directing the Treasury secretary to restrict rewards if stablecoin activity causes deposit flight from community banks on a substantial scale.
