CLARITY Act Faces Uncertain Future as Grayscale Sees Regulatory Gaps

Grayscale Research Director Zach Pandl has expressed doubts about the passage of the CLARITY Act, a bill aimed at creating a comprehensive regulatory framework for the US cryptocurrency market. The Senate's busy schedule and election year politics make it difficult to reach a bipartisan agreement on the bill.

The lack of comprehensive regulation could slow new investment activity and capital formation in the U.S., according to Grayscale. However, Pandl noted that federal regulators will continue to fill regulatory gaps in the crypto sector even without new legislation.

Significant progress has been made under the current administration in areas such as institutional custody services, banking access, staking, and crypto exchange investment products. However, Pandl warned that without comprehensive market structure legislation, a larger portion of new investments and developer activity could shift to countries outside the US.
