Clarity Act Falters, Crypto Industry May Not Need It
The Digital Asset Market Clarity Act, aimed at clarifying distinctions among crypto securities, commodities, and assets, has stalled in the U.S. Senate.
The legislation's primary goal was to define oversight authority for companies handling these assets, but it may not pass this year due to contentious debates over stablecoin yield, illicit finance, and government officials' ethics.
Despite its potential demise, crypto insiders argue that the industry can operate without a bespoke law, pointing out that the SEC and CFTC have been actively developing position statements and leveraging existing authorities to support crypto businesses.
