The CLARITY Act is facing potential Senate failure as it heads towards a procedural vote on September 15. Despite bipartisan support in the House, where it passed with 294 votes to 134, the bill has encountered resistance in the Senate due to ethics restrictions and regulatory authority.

Republican senators have expressed concerns that the measure could fail without further movement on ethics language, particularly regarding President Donald Trump's financial interests. Democrats continue to push for stronger rules governing presidential and family crypto interests.

Senator Cynthia Lummis has rejected claims that ethics is the only barrier, instead blaming wider Democratic demands across unresolved policy areas. She argues that Democrats should make additional compromises rather than place responsibility solely on the White House.

The legislation would create a broader federal framework for digital asset market structure and has been described as setting clearer rules for digital assets by Senate Banking Committee Chairman Tim Scott. However, the dispute over ethics restrictions has reduced the margin for agreement before the scheduled procedural vote.
