CLARITY Act Senate Showdown: Law Enforcement vs Crypto Industry Over Decentralized Finance Rules

The CLARITY Act is at the center of a high-stakes showdown in the US Senate, where cryptocurrency industry advocates and law enforcement officials are clashing over proposed rules for decentralized finance.

The Blockchain Association has sent a letter to Senate Majority Leader John Thune and Minority Leader Chuck Schumer refuting claims that the bill would exempt DeFi platforms from anti-money laundering and sanctions requirements. Instead, the association argues that the law draws a distinction between those who exercise actual control over customer assets or transactions and software developers who provide neutral software.

The CLARITY Act would prevent software developers and people who provide self-custody tools or maintain blockchain infrastructure from being classified as money transmitters in the US, unless they have exclusive control over their users' digital assets or can unilaterally transact on behalf of these users. This approach is consistent with existing principles, according to the Blockchain Association.

The law enforcement community has a mixed reception to the bill, with some supporting its control-based regulatory framework while others want to expand its scope to include more participants. The proposal also provides substantial funding for digital asset investigations and blockchain analysis resources for FinCEN.
