CLARITY Act Stalls as Senate Approaches Summer Recess
The prospects for passing the Digital Asset Market CLARITY Act in the US Senate are uncertain as lawmakers approach their summer break. Senate Majority Leader John Thune has expressed limited confidence in securing full passage of the bill before the chamber adjourns for the August recess.
Thune's comments to reporters indicate that initiating formal consideration of the cryptocurrency market structure bill on the Senate floor may be possible, but completing the process prior to the recess is unlikely. Negotiators and industry participants had previously viewed the period leading up to early August as a key opportunity for progress this year.
The CLARITY Act aims to create a structured regulatory environment for digital assets by clarifying oversight roles among federal agencies. However, it continues to face unresolved issues, including discussions around ethics rules for public officials and the need for sufficient bipartisan support to reach the 60-vote threshold required in the Senate.
Galaxy Research has lowered its estimated probability of the bill's enactment in 2026, reflecting the narrowing window of available floor time and competing priorities on the congressional agenda. Initiating the multi-stage Senate floor process before the recess could allow for continued work during the shorter September session, although further action by the House would still be necessary.
