CLARITY Act Stalls as US Congress Struggles with Digital Asset Regulation
The Digital Asset Market Clarity Act (CLARITY Act) is a comprehensive federal framework for digital assets that has gained bipartisan support in the US Congress. The bill aims to establish clear rules governing crypto markets, but its passage is not guaranteed due to political obstacles.
Bipartisan engagement with the legislation has produced a draft exceeding 600 pages, addressing issues like the SEC-CFTC jurisdictional split and developer protections. However, reaching the 60-vote threshold in the Senate requires Democratic support alongside a unified Republican caucus, which is complicated by election-year priorities.
Himanshu Sahay of Arch noted that 'the biggest challenge will be reaching agreement on how different digital assets should be classified and regulated.' The core frustration among industry observers is that the stalemate has very little to do with whether crypto deserves a regulatory framework.
If the CLARITY Act passes, it would not immediately rewrite the rules governing crypto markets. Instead, it would establish authority for regulators to create those rules through formal rulemaking processes that can take years to complete. This means passage is just the starting line for implementation.
