Clarity Act Stalls in Senate Amid Misconceptions About Crypto Regulation
The Clarity Act aims to bring a regulated crypto market to the United States, reducing theft and closing regulatory loopholes for consumers and investors. Despite passing the Senate Banking Committee in May with a 15-9 vote, the bill has been stalled due to misconceptions about its impact on law enforcement.
Jim Fotis of the National Center for Police Defense states that the Clarity Act gives law enforcement more flexibility to respond to illicit activities and provides clear rules and regulations. However, some critics believe it loosens oversight of digital asset markets.
This interpretation is inaccurate, as the bill significantly expands anti-money laundering and sanctions obligations for regulated intermediaries, subjecting them to registration, supervision, examinations, record-keeping, and enforcement under a single federal framework.
The Clarity Act also enhances the ability of Federal Monitoring and Enforcement Agencies to work more efficiently under the US legal system. Critics claim that it narrows law enforcement's ability to go after criminals using digital assets, but this is not true.
