Clarity Act Stalls in Senate, Crypto Industry Left to Navigate Uncertainty
The Clarity Act, aimed at providing a coherent regulatory framework for the crypto industry, is unlikely to pass this year. According to Zach Pandl, Head of Research at Grayscale, the bill has stalled in the Senate due to lack of crossover votes. The bill was designed to clarify the roles of the SEC and CFTC in overseeing securities and digital commodities.
The House passed the Clarity Act on July 20, 2025, with a 294-134 vote. However, after being revised in July 2026, seven Democratic members pushed back against it, making it difficult for Senate leadership to schedule a full vote. With the recess window closing around August 7, 2026, time is running out.
Pandl emphasized that on-chain protocols may still find value despite legislative uncertainty. Prediction markets have reflected growing pessimism, with odds of the Clarity Act passing drifting below 50% as of early August 2026.
