Clarity Act Update Hits Fresh Roadblock Ahead of Senate Vote
The Clarity Act update, a bill aiming to establish a federal framework for digital assets, faces another hurdle before its critical Senate vote. The latest challenge comes from New York Attorney General Letitia James and 17 other attorneys general who have expressed opposition to the measure.
Their main concern is that the language allowing the Securities and Exchange Commission (SEC) to preempt state registration authorities could create legal uncertainty around state securities oversight and fraud cases.
James argues that the bill could 'muddy the waters' for cases against crypto scams and platforms that violate state law. She cites over 330 state anti-fraud actions since 2017, resulting in $11.4 billion in crypto fraud losses from FBI complaints in 2025.
