The Senate's vote on the CLARITY Act has been delayed until at least September, leaving crypto markets in limbo. The bill, which aims to provide clarity on digital assets and their classification as securities or commodities, had been expected to be voted on before the August recess.
Ripple's CEO claims that XRP is already 'safe' due to a prior court win, but critics argue that this ruling has limitations and may not protect the token from future regulatory changes. A district-level ruling does not automatically bind future enforcement across the board and lacks the weight of legislation passed by Congress.
Charles Hoskinson's warning still lingers, as he believes that even if the CLARITY Act passes, it will treat new digital assets as securities by default, forcing projects to petition the SEC and prove they meet a 'mature blockchain system' standard before being treated as commodities. This could slow down applications, stretch definitions of common control, or lean on tests around token distribution and value attribution.
