The Clarity Act has been stalled due to disagreements over an ethics provision that would limit President Trump's ability to profit from his family's crypto ventures. A bipartisan compromise proposal from Senators Thom Tillis and Ruben Gallego has been pending with the White House since late July without a public response.
Industry figures tracking the talks warn that continued silence from the administration could make it harder for Democrats to justify crossing the aisle, while engagement with the Tillis-Gallego proposal before Tuesday's vote could shift several undecided Democrats and change the vote math quickly.
The cloture vote requires 60 votes to open debate on the legislation, but supporters need close to nine Democratic votes to clear the bar. A pass on Tuesday would start debate, but it does not deliver a law.
