Commodities Clarified, Spot Market Supervision Remains Elusive
The Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC) issued a joint interpretation in March 2026, clarifying that Bitcoin, Ether, XRP, Solana, and Dogecoin are digital commodities, not securities.
This ruling did not address the question of who oversees the massive spot market where these tokens change hands.
The distinction between the two agencies' mandates is key: the SEC regulates securities, while the CFTC governs derivatives markets.
For example, a Bitcoin futures contract falls under CFTC jurisdiction, but trading Bitcoin on a spot exchange does not. XRP's status as a digital commodity is also complex, as certain transactions involving the token can still fall under securities law.
