Crypto Can Survive Without Clarity Act, Says CoinFund's Chris Perkins
Chris Perkins, managing partner at CoinFund, believes that the cryptocurrency industry can continue to develop even if the CLARITY Act fails to become law. The bill aims to establish clearer rules for digital assets and determine how regulatory responsibilities should be divided between the SEC and CFTC.
Perkins argues that regulators in Washington are already establishing a framework for the market through agency action, citing the SEC and CFTC's authority to interpret and enforce existing laws, issue guidance, and establish regulatory precedents. He points out that the absence of new legislation would not necessarily stop the crypto industry's progress.
The Senate recently postponed consideration of the CLARITY Act until September, adding to the uncertainty surrounding its passage. The bill has faced significant political obstacles, including negotiations over provisions involving investor protections, stablecoins, government officials' involvement in crypto, and anti-money-laundering requirements.
Perkins acknowledges that a law passed by Congress can provide a durable statutory framework, while agency guidance and regulatory decisions can change more quickly as administrations and leadership change. He sees legislation as an additional layer of certainty that could strengthen rules already emerging through regulators.
