Crypto Hedge Fund Manager Sentenced to Prison for Tax Evasion
A US-based crypto hedge fund manager, Justin Ryan Schmidt, has been sentenced to 37 months in prison for tax evasion after renouncing his US citizenship. The case highlights the risks of using expatriation as a means to avoid paying taxes on cryptocurrency gains.
Schmidt earned between $6 and $7 million from his hedge fund, Translunar Crypto LP, between 2020 and March 2022. However, when he renounced his US citizenship on March 3, 2022, he submitted false expatriation paperwork claiming a net worth of just $25,000.
The move was designed to avoid the 'exit tax', which requires departing citizens to settle up with the IRS on unrealized gains and outstanding obligations before they leave. Schmidt also concealed foreign bank accounts, violating FBAR (Foreign Bank Account Report) requirements, which can carry penalties of up to $100,000 per violation or 50% of the account balance, whichever is greater.
