Crypto Industry Hangs in Balance as CLARITY Act Faces Uncertain Fate

The US Senate is set to consider the Digital Asset Market Clarity (CLARITY) Act, but its passage is not guaranteed. Senator John Thune has scheduled a cloture vote for Tuesday, which requires support from at least five Democrats to overcome a filibuster. If the bill fails, it may be delayed until 2027 when a new session of Congress takes over.

Senator Cynthia Lummis warned that if lawmakers are unable to reach an agreement and send the bill to the president's desk, the next real opportunity for passage might not come until 2030. The midterm elections in November will determine which party controls the Senate, with event contracts on prediction market platforms currently giving Democrats a slight edge.

The crypto industry is pushing for more pro-crypto lawmakers in Congress and has been actively supporting candidates who favor the CLARITY Act. A PAC like Fairshake, backed by Coinbase and Ripple Labs, has spent millions of dollars on ads supporting favored candidates. However, not all efforts have been successful, with some incumbents facing negative ads from crypto-backed groups.

The outcome of the midterm elections will not change Republican control of the White House until January 2029, when President Trump's term ends and a new president takes office. Additionally, the heads of major financial agencies, such as the SEC and CFTC, are unlikely to change in the near future, signaling plans to proceed with digital asset regulation if Congress fails to advance CLARITY this year.
