The crypto industry is showing renewed optimism as Senate Republicans release a revised Clarity Act, their 'last, best and final offer' ahead of Tuesday's cloture vote. The bill includes tougher ethics rules that President Trump had previously resisted, including divestment or blind trusts for officials with significant financial interests in digital assets.
The changes also touch on the Blockchain Regulatory Certainty Act, removing explicit protections from criminal prosecutions under Section 1960 and adding civil protections for developers who do not control customer funds. Republicans beefed up the bill's civil protections to make it clearer that developers should not be treated as money transmitters if they don't control customer funds.
The industry reaction is largely positive, with Galaxy Digital Head of Research Alex Thorn raising his 2026 passage odds from 10% to 25%. However, the tight calendar remains a hurdle for the bill's passage. The revised Clarity Act aims to address concerns about conflicts of interest and investor protection, particularly in light of Trump's significant income from crypto ventures last year.
