Crypto Investor's Dilemma: Can Indian Law Provide Relief?

Share

A crypto investor opens his exchange app to find that his withdrawal request has been pending for hours. Despite a visible balance, he can't access his funds.

The fine print of the exchange's terms and conditions seems to give them wide discretion to restrict withdrawals without explanation.

This raises questions about whether Indian law offers any remedy for such grievances.

While there is no separate statute governing consumer rights for crypto investors, existing laws can still provide protection.

The Consumer Protection Act of 2019 applies to services supplied by exchanges, and a retail investor who pays for their services may claim to be a consumer.

A key factor in determining this is the investor's legal identity. Section 2(7) of the Consumer Protection Act includes online transactions, and if an exchange is providing services to an individual, they can claim to be a consumer.
