This would have major consequences for Ripple Labs, which could face fines for selling securities without registration.

The Howey test is used to determine whether a particular crypto asset is a security. Under this three-part test, a digital asset can be classified as a security if it meets certain criteria. If Ethereum were considered a security, its price would likely drop, and exchanges trading in the asset would face fines for not registering with the SEC.
