Crypto Regulation Takes Shape: US Senate Advances CLARITY Act

The US is on the verge of creating a comprehensive framework for regulating the cryptocurrency industry. The proposed CLARITY Act aims to establish clearer rules for determining when digital assets are securities or commodities and which federal agencies are responsible for regulating them.

Crypto companies have long argued that existing financial regulations were designed for a different era, but this legislation could provide a much-needed clarity. However, the proposal also exposes an increasingly important conflict: crypto companies are no longer just competing with each other, they're now competing directly with banks.

The Senate proposal attempts to draw a line between the two systems by prohibiting crypto companies from paying passive interest or yield simply for holding payment stablecoins. However, it would allow certain legitimate transaction- or activity-based rewards. Banks have pushed back against this distinction, arguing that even reward-based stablecoin products could encourage customers to move money away from traditional bank deposits and into digital-asset platforms.

The CLARITY Act would subject digital commodity exchanges, brokers, and dealers to anti-money-laundering, customer-identification, and due-diligence requirements under the Bank Secrecy Act. This would bring significant portions of the industry closer to the compliance standards already familiar to traditional financial institutions.
