The company will only purchase cryptocurrencies that it determines are not securities. This assessment will be made through a facts-and-circumstances analysis, drawing from relevant law and regulatory guidance, including the Howey Test.
Regulatory compliance is crucial for the firm, which plans to seek regular guidance from external legal counsel and track new regulatory developments. Whenever there is a significant regulatory announcement or court decision that may influence the status of a crypto asset, the company will reassess its classification.
The firm emphasized the advantages of purchasing digital assets through institutional exchange accounts instead of using retail platforms. A direct comparison in October 2025 demonstrated that buying $5,000 of XRP through Coinbase Prime (institutional) was approximately ten times less expensive than acquiring the same amount through a Coinbase retail account.
