EU Regulators Weigh Bringing DeFi Lending Vaults Under MiCA Oversight
The European Commission is reviewing the regulatory framework for decentralized finance (DeFi) lending in the EU, specifically targeting on-chain structures known as 'lending vaults'.
Lending vaults are designed to provide credit markets with large pools of assets while sidestepping traditional lender hallmarks. However, their legal treatment has often relied on non-binding interpretations that they may not fall under existing EU regulations, such as the Markets in Crypto Assets (MiCA) framework.
The debate is expected to intensify around the regulatory classification of lending vaults, with some arguing that decentralization should be the dividing line. However, others suggest that using structural criteria and user exit rights would provide a safer ground for regulation.
