Exchanges Face Growing Legal Risks After Major Cyberattacks
Major cyberattacks on crypto exchanges have become increasingly common in recent years. While the immediate focus is often on the value of assets lost, exchanges and other cryptoasset service providers face a more significant challenge after the initial breach.
A major security incident can trigger regulatory scrutiny, customer claims, investor concerns, insurance disputes, and complex asset recovery exercises. Not every hack implies negligence; sophisticated criminal groups and state-sponsored actors devote substantial resources to targeting digital asset businesses, often using techniques that evolve faster than security controls.
Exchanges may need to contain the attack, investigate what happened, preserve evidence, notify regulators, communicate with customers, assess insurance coverage, and consider asset recovery. These decisions can themselves become relevant to subsequent litigation or regulatory scrutiny.
The question of whether an exchange took reasonable steps to prevent the hack and responded appropriately is becoming increasingly important as the crypto sector matures and becomes more heavily regulated.
