Grayscale Paints Bright Picture for Crypto Despite CLARITY Act Uncertainty
The CLARITY Act's uncertain fate has led Grayscale to outline an alternative plan for the US crypto industry. Despite the bill's stagnation, the company believes a path forward exists.
Grayscale's analysis acknowledges that while an agreement this year remains technically possible, the Senate calendar and upcoming midterm elections make official passage increasingly difficult. The report comes as Senate Majority Leader John Thune filed cloture on the motion to proceed with the legislation before lawmakers left Washington last week.
The procedural vote is scheduled for September 15, but it still requires 60 votes, which is not a final vote on the bill. If they fail to advance it, Grayscale argued that regulatory agencies like the CFTC and SEC can continue developing rules and interpretations governing the market even if Congress remains on the sidelines.
The CFTC and SEC have become more accommodating toward the crypto industry compared to previous years. While they are limited in what they can accomplish without new legislation, particularly when it comes to establishing permanent jurisdictional boundaries between themselves, they can still address some major points of inflection within the industry, such as tokenized securities, custody, and trading.
