Husted Seeks Senate Approval for Clarity on Digital Asset Regulation
Senator Jon Husted has publicly endorsed the Digital Asset Market Clarity Act (CLARITY Act) in his efforts to bring clarity to the regulation of digital assets. Introduced by Representative French Hill on May 29, 2025, the bill aims to establish clear jurisdictional lines between the CFTC and SEC over digital assets.
The CLARITY Act would hand primary oversight of spot digital commodity markets to the CFTC while carving out specific, limited jurisdiction for the SEC. One notable provision involves exemptions for mature blockchain projects that have reached a sufficient level of decentralization.
Husted's support comes as the Senate faces a limited window before the August recess to take up the bill, which has already passed the House with H.R. 3633 on June 1, 2026. However, passing something through the Senate is a fundamentally different sport, requiring a 60-vote threshold.
Galaxy Research recently reduced its estimated odds of the CLARITY Act passing in 2026 from 50% to 30%, citing procedural realities and the crowded legislative calendar. If the bill eventually becomes law, it would open the door for regulated trading venues that institutional players have been waiting for.
