India Balances Innovation with Regulation in Cryptocurrency Market

India's regulatory framework for cryptocurrencies and digital assets is evolving to balance investor protection and innovation. The country has a large technology ecosystem, digitally sophisticated population, and significant interest in blockchain and Web3.

Regulators globally are moving towards clearer rules, with the European Union's Markets in Crypto-Assets Regulation (MiCA) being one of the most comprehensive examples. MiCA establishes rules for crypto-asset issuance and service providers, aiming to create regulatory consistency across member states while supporting innovation.

The US has also moved towards greater regulatory clarity, with the Securities and Exchange Commission issuing an interpretation on how federal securities laws apply to certain crypto assets in March 2023. Dubai's Virtual Assets Regulatory Authority (VARA) operates a dedicated licensing regime for virtual-asset activities, including exchanges, custody, and lending.

India has some building blocks for a formal digital-asset framework, including registration requirements under the Prevention of Money Laundering Act and a specific tax framework for VDAs. However, connecting these pieces into a clearer, comprehensive market framework is the next challenge.

A risk-based regulatory approach could help India achieve this balance. Regulators could focus on activities that pose significant risks, such as exchanges and brokers, custodians, stablecoin issuers, token issuers, and DeFi and Web3 infrastructure.
