The adoption of digital assets by institutions remains hindered by a fundamental question: who controls the assets when something goes wrong?

Custody is not just about storing private keys, but also defining ownership, operational control, audit procedures, client reporting, risk management, and board approval. For asset managers, hedge funds, corporate treasuries, family offices, and fintech companies, institutional crypto custody is a governance question that affects every aspect of their operations.

The rise of exchange-traded funds (ETFs) has made it easier for institutions to access digital assets, but it has not solved the custody problem. ETFs provide exposure to digital assets, but they do not address the need for secure custody models that can withstand legal review, operational testing, and internal risk approval.

The regulatory landscape is still evolving, with the Securities and Exchange Commission (SEC) withdrawing its proposed safeguarding rule in 2023 and leaving institutions to navigate a complex and inconsistent framework. The European Markets in Crypto-Assets Regulation (MiCA) provides more structure, but global consistency remains elusive.
