Korea's Cryptocurrency Tax Sparks Fears of Capital Flight
The South Korean government's plan to introduce a 22% tax on cryptocurrency gains has sparked concerns among investors and industry experts. Starting next year, the tax will be applied to annual gains after deducting necessary expenses and a basic exemption of 2.5 million won. Investors who earn more than this amount could face significant tax bills, with an investor earning 10 million won in net gains potentially facing a tax bill of 1.65 million won.
The government plans to classify income from the transfer or lending of virtual assets as other income for tax purposes. However, concerns persist over the lack of clarity in the detailed rules. A key issue is how to determine the cost basis of assets transferred from overseas exchanges or personal wallets to domestic exchanges. If investors cannot prove their acquisition costs and only 50% of the sale proceeds are recognized as a deductible expense, they could end up paying taxes far exceeding their actual gains.
Guidelines for newer types of cryptocurrency transactions also remain limited. The tax law does not clearly specify when income is recognized or how acquisition costs should be determined for staking rewards or airdrops. Industry groups are calling for the basic exemption to be raised to between 6 million won and 20 million won, arguing that an excessively low exemption could result in administrative costs exceeding tax revenues while placing a reporting burden on small-scale investors.
Experts warn that imposing the tax without strengthening the regulatory framework could accelerate capital outflows. About 700 trillion won in funds has already moved from South Korea to overseas exchanges since 2021, and the additional tax burden could further weaken the competitiveness of domestic exchanges. An industry official stressed that the government should first establish a legal foundation and investor-protection framework for the industry before discussing taxation while considering fairness with other asset classes.
