Legacy Bitcoin Holdings May Qualify for Tax-Free Treatment in Austria
Austrian investors who bought Bitcoin before February 28, 2021 may hold a significant tax advantage when selling their coins. The country's crypto tax regime in force since March 2022 generally taxes gains at 27.5 percent, but older holdings are treated under transitional rules.
Those who purchased Bitcoin in 2020 or earlier can potentially sell their coins tax-free if they have held them unchanged since the purchase date. If the sale occurs more than a year after the acquisition, the increase in value is generally not subject to taxation.
However, investors should be aware that swapping Bitcoin for another cryptocurrency before selling counts as a disposal and can affect legacy status. Lending or using old Bitcoin to generate ongoing crypto income also complicates matters, as such activities fall under the new tax regime and the resulting coins are considered new holdings.
To qualify for tax-free treatment, investors must be able to document their transactions and show that the Bitcoin being sold still traces back to a purchase made before March 2021. This includes maintaining records of wallet addresses, blockchain transactions, and any earlier crypto-to-crypto swaps or lending activities.
