Lummis Proposes CLARITY Act to Clarify Digital Asset Regulation
Senator Cynthia Lummis has proposed the CLARITY Act, a bill aimed at clarifying when digital assets stop being securities. The legislation introduces the concept of 'ancillary assets,' which would distinguish between investment contracts and digital assets that operate independently.
The proposal addresses one of the longest-running questions in crypto regulation: how to determine when a blockchain-based asset evolves beyond securities laws. Existing laws, written decades ago, may not fit modern digital assets. The CLARITY Act seeks to provide greater certainty by establishing clearer legal standards governing this transition.
Lummis emphasizes that the bill balances innovation with investor protection. Industry participants have long argued that regulatory uncertainty discourages innovation and creates compliance challenges for blockchain companies operating in the US. Clearer legislation could reduce these barriers and strengthen confidence throughout financial markets.
