MiCA Regulation Casts Shadow Over DeFi Lending and Borrowing
The European Commission is considering bringing decentralized finance (DeFi) lending and borrowing under the scope of the Markets in Crypto Assets (MiCA) regulation. A consultation on the review of MiCA's rules closed September 30, 2023, with stakeholders weighing in on how to regulate DeFi vaults.
According to EU digital assets lawyer Yuriy Brisov, the current law surrounding DeFi lending is unclear, and lenders use various structures, such as smart contracts, to perform economic functions without being labeled as traditional lenders. This makes it difficult for regulators to determine who should be responsible under MiCA.
Morpho's Vault V2 architecture, which divides responsibilities between an owner, curator, allocator, and sentinel, is a prime example of this complexity. Jonathan Galea, a partner at Cahill Gordon & Reindel, argued that policymakers should treat lending vaults as distinct structures rather than a single category, citing their role in directing fragmented liquidity into lending markets.
Michael Egorov, Curve Finance founder, emphasized the need for a tailored regulatory framework that accounts for DeFi's unique characteristics and differences from traditional finance. He cautioned against applying rules that may not be suitable for newer protocols or those built on decentralized principles.
