OCC Shifts Focus to Material Financial Risks in Bank Supervision Overhaul
The Office of the Comptroller of the Currency (OCC) has revised its bank supervision and enforcement framework, shifting the focus from minor procedural deficiencies to material financial risks and substantive legal violations. The changes aim to improve consistency in supervisory actions by considering a bank's size, complexity, and potential customer harm.
Under the new framework, examiners will prioritize addressing conduct that creates material financial risk, such as systemic patterns or significant financial effects. Technical violations, on the other hand, may not require enforcement actions but can still necessitate correction.
The revised rules also divide legal violations into 'substantive' and 'technical' categories based on potential customer harm. Substantive violations can result in an MRA (Matter Requiring Attention), while technical violations are subject to correction without further action.
