Peirce Stays Bullish on CLARITY Act Amid Regulatory Uncertainty
Outgoing SEC Commissioner Hester Peirce remains optimistic about the passage of the CLARITY Act, which aims to simplify regulation by defining agency jurisdiction over different parts of the digital asset market.
In an interview on the 'Policy Protocol' podcast, Peirce stated that she is still optimistic that the bill will be passed. She believes the legislation would help establish clearer oversight for cryptocurrency spot markets and address uncertainty surrounding platforms that trade both securities and non-security digital assets.
Peirce noted that if Congress fails to pass the CLARITY Act, the SEC could still take significant action by developing new frameworks while clarifying how existing securities rules apply to digital assets. She identified mixed-asset trading platforms as an area where legislation would be particularly helpful, citing the example of transactions involving both security and non-security crypto assets.
As she prepares to leave the SEC for academia, Peirce urged cryptocurrency industry builders to focus less on regulatory ambiguity and more on developing products that offer genuine value. She emphasized the importance of entrepreneurs creating products that people want and need, arguing that regulators should allow experimentation and financial decision-making with the possibility of failure.
